Terms of Service

These Terms of Service ("Terms") govern your use of the Brivkor platform — including brivkor.com, saas.brivkor.com, and app.brivkor.com (collectively, the "Services") — operated by M4siz Limited, trading as Brivkor. By creating an account or using any part of the Services, you agree to these Terms in full. If you do not agree, do not use the Services.

2. The Services

Brivkor provides two Continuing Professional Development (CPD) management products:

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with reasonable notice where practicable.

3. Accounts and Eligibility

We may suspend or terminate accounts that violate these Terms, misuse the Services, or are inactive for more than 12 months with no paid subscription.

4. Free Trial

New accounts receive a 14-day free trial giving access to paid-tier features. No credit card is required to start a trial. At the end of the trial period, your account automatically reverts to the Free tier. You may upgrade to a paid plan at any time during or after the trial.

5. Subscriptions and Billing

Paid subscriptions are billed in GBP (£) and processed securely through Stripe. We do not store your payment card details. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

Current plan pricing is listed on the pricing page. We reserve the right to change prices with at least 30 days' notice to existing subscribers.

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period; you retain access to paid features until that date.

We do not offer refunds for partial billing periods except where required by applicable law, or at our sole discretion in exceptional circumstances. If you believe you are entitled to a refund, contact us at billing@brivkor.com.

Under the UK Consumer Rights Act 2015 and Consumer Contracts Regulations 2013, where you are a consumer you may have a 14-day right of withdrawal from a new subscription. This right is waived if you explicitly request that service provision begin immediately and acknowledge that the right of withdrawal is lost upon commencement of the service. By starting a paid subscription, you agree to immediate service commencement.

You retain ownership of all CPD records, documents, and other content you upload ("Your Content"). By uploading content, you grant us a limited, non-exclusive licence to store and process it solely to provide the Services.

You are solely responsible for the accuracy, legality, and integrity of Your Content. We do not verify CPD records submitted through the platform.

9. Intellectual Property

All intellectual property in the Services — including software, design, trademarks, and documentation — belongs to M4siz Limited or its licensors. Nothing in these Terms grants you any rights in the Services other than the limited right to use them as described.

10. Data and Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data. It forms part of these Terms. We process personal data in accordance with UK GDPR and the Data Protection Act 2018.

11. Data on Account Closure

If you delete your account, or if we terminate your account due to a Terms breach, your data will be deleted from our systems within 30 days, subject to any legal retention obligations. You may export your CPD records before closing your account. Organisation administrators are responsible for notifying their team members before closing an organisation account.

12. Limitation of Liability

To the maximum extent permitted by English law:

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

13. Third-Party Services

The Services integrate with third-party providers including Stripe (payments), Brevo (transactional email), Sentry (error monitoring), and Railway (database hosting). Your use of the Services is subject to those providers' own terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified by email to registered users at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the law of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also be entitled to bring proceedings in the courts of the country where you are resident.
